Let's be fair--back when TSR launched their ill-considered web policy, the Internet was a new and somewhat frightening thing. I think they gravely overreacted, but I can also understand why they did so.

WotC, on the other hand, has fourteen years of Internet experience, the OGL, the Official Fan Site experiment (which appears to have been positive to mixed at worst) and TSR's own mistakes to guide them. What's their reasoning?

EDIT: Okay, taking a closer look at it, it doesn't appear as bad as it's been made out to be. But IANAL--or even a website maintainer--and have no real feel for all the implications. It does give me the impression of having been designed for the MAGIC fanbase first and foremost, with the D&D fans being treated as a sideline and shoved aside with a "see the GSL" without considering some of the other elements (what happens to those maintaining sites for the out-of-print settings and gamelines?) that might be of concern. But that could be my own priorities and prejudices speaking.
