They haven't been republished -- the creatures have the same names, but are different critters, sometimes dramatically so.

And I think people are overstating the agreement with Necromancer Games; as I understand it, it was that WotC wouldn't use more than a handful of names in products under consideration at that time, not "we will never, ever, never publish creatures with these names," which would have been an insane agreement for WotC to enter into and one that their lawyers would have certainly prevented from happening.
