You say that you can get the Ultimate Powers book freely and legally at the link you provide. I really doubt that it's actually legal.

The games were not made public domain, and WOTC, by virtue of buying TSR, would still have the copyrights to the books. They choose not to use the old system, no longer have the Marvel license, etc., but there's absolutely no reason to believe that it's legal to download those books, unless I missed an announcement by WOTC and Marvel to that effect.

This whole idea that just because a game is no longer sold that it's now "abandonware" and perfectly fine to distribute for free is not supported by any laws.
