Why, exactly, is WotC expected by be gutsy in cases where someone else is reaping the profit? Sounds pretty stupid to me. If they're going to be sued for inappropriate material, probably by someone from Texas, they might as well be sued for a product they actually made money from.

It isn't hypocrisy if it is the logical approach to the situation. The problem is that the legal system itself may be screwed up... or maybe we can simply accept decency clauses as an imperfect but necessary solution to a very real problem.
