No, actually you can, you just can't use the D20 logo on it.
It is, in fact, a product using the D20 rules that does, in fact, have character creation rules in it, so they couldn't use the logo. But to claim that it isn't really D20 just because they didn't use the logo is pretty foolish.

Except for the fact that it's NOT descriptive.
Calling the game OGL because it was released using D20 rules under the OGL is like "GURPS Horror" calling itself "Copyright Horror" because it was released under copyright and uses GURPS rules. Would you be here trying to claim that Copyright Horror is a descriptive title?
OGL means nothing about what type of game it is. They'd have been better off coming up with some new catchphrase to describe the line of books that would have some descriptive meaning instead of trying to confuse people into thinking that OGL means "D20 without using the D20 logo."
Not to mention now the idiots are in a position where they probably think they can block some other company from releasing a product with "OGL" on it.
