Well, if that's all that bugs you (as it did me), they also have an (optional) hit die system, that gives VERY different results!
It's a little more cumbersome than the 'Saving Throw' version, but high-level characters are a LOT tougher than low-level ones, as it should be!
And, the Saving Throw system works 'well enough' for those who really want a simple, fast, easy game mechanic, and don't really care for all the 'crunchy' stuff.
As to Game Balance issues, I don't see your problem...
Since everybody starts with the same available choices, shouldn't the person who 'spends their points better' have an advantage?
Not that it's a very great advantage...
The 'Level Caps' tend to keep people of the same level from having a Protection level high enough to be able to 'ignore' incoming attacks, and there are enough Feats that can boost your Damage enough that even those can be overcome!

Is M&M the 'perfect' Superhero RPG?
No, but it IS a good bit 'better', for most people's needs, than anything else out there!
